The question of what is an appropriate legal remedy in the event of a separation that lasts for more than six months but not more than a year is one that arises with increasing frequency. The Law Commission of India has proposed that couples who are separated for more than six months but not more than a year should be able to avail themselves of civil remedies such as mediation and arbitration, notwithstanding any religious or moral objections on the part of either party. However, in practice this option is not available to all couples. This is because many courts do not have the jurisdiction to entertain cases where there has been a separation lasting more than six months. In addition, many couples find it difficult to access civil remedy since they do not have the resources or knowledge to pursue their rights effectively.
