In many cases, one sided divorces are possible. In order for a divorce to be legally binding, both parties must agree to it. If one party does not consent, the divorce cannot proceed. However, there are a few exceptions to this rule. If one spouse is physically or emotionally abusive towards the other, or if there is any form of domestic violence involved, then a court may declare the marriage void and grant the other party a legal separation instead. In these cases, both parties would still have to agree to a formal divorce in order to make it official.
