In most cases, a wife must obtain her husband’s written consent to file for divorce. However, there are a few exceptions to this rule. If one of the spouses is physically or mentally incapacitated, or if there is an imminent threat of violence against either spouse, the court may grant a divorce without the other spouse’s consent. Additionally, if one spouse has concealed information about their marital status from the other spouse for reasons of abuse or neglect, then that spouse may be able to file for divorce without their partner’s approval.
